By using this site and making use of the service offered by 8bitsafe ("the Company"), you agree to abide by the following Terms and Conditions. These Terms and Conditions cover all present and future features offered by your account, individually and collectively referred to as the "Service".

Account Creation and Access

When you create a 8bitsafe account you will be required to set your account credentials – an email address and a password that you choose. You may optionally configure a second factor on your account. You are responsible for accurately maintaining your account credentials, including the devices, codes, etc. used for the second factor if you choose to use one.

To log in to your account and access your files you will be required to provide valid account credentials, including any second factor you had previously configured. 8bitsafe is under no obligation to provide you access to your account or your files if you are unable to provide the appropriate account credentials including any second factor you have configured.

Service Cancellation and Account Deletion

You can cancel your 8bitsafe service and then delete your 8bitsafe account any time you'd like by simply signing in to your Account. To cancel your 8bitsafe service, you will be required to log in to your account and delete all of your encrypted backups stored on our system.

To log in to your account and access your files you will be required to provide valid account credentials, including any second factor you had previously configured. 8bitsafe is under no obligation to provide you access to your account or your files if you are unable to provide the appropriate account credentials including any second factor you have configured.

8bitsafe is provided "as is" without any warranties, express or implied. 8bitsafe disclaims all warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent allowed by law, 8bitsafe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to, use of, inability to access, or inability to use 8bitsafe

Payments and Billing

8bitsafe accepts major credit cards and debit cards payments.

We use third-party payment processors (the "Payment Processors") to bill you through a payment account linked to your Account on the Services (your "Billing Account") for use of the paid Services. The processing of payments may be subject to the terms, conditions and privacy policies of the Payment Processors in addition to this Agreement. We are not responsible for error by the Payment Processors. By choosing to use paid Services, you agree to pay us, through the Payment Processors, all charges at the prices then in effect for any use of such paid Services in accordance with the applicable payment terms and you authorize us, through the Payment Processors, to charge your chosen payment provider (your "Payment Method"). You agree to make payment using that selected Payment Method. We reserve the right to correct any errors or mistakes that it makes even if it has already requested or received payment

All payments are processed securely through Stripe. 8bitsafe does not directly process payments through the website.

Recurring Billing

8bitsafe automatically bills your credit card each month or every year. Billing is based on the plan for which you signed up. For 1-year plans, we will send an email to the account's email address ahead of time to remind you that your renewal is coming up.

Charge Disputes

If you have any dispute regarding charges to your account, you have 30 days from the date of the charge to dispute it.

Cancelling Service

To cancel a service, simply sign-in to your Account, delete all services.

Lapsed Subscriptions

If your 8bitsafe subscription lapses and we are unable to re-bill your account to renew your subscription, devices on your account will stop backing up. Continued non-payment will result in your encrypted backup data being deleted.

Our Rights

We're always working to improve 8bitsafe and make our services better, so we do reserve some rights. In our sole discretion, we may, at any time—with or without notice—change, eliminate or restrict access to our services, and modify, suspend, or terminate a user account. If you stop paying for our service, we reserve the right to terminate your account and delete your data. 8bitsafe is not liable for any damages as a result of these actions.

Privacy

Our Privacy Policy governs our collection and use of your personal information. Please review those provisions, too.

We take the security of 8bitsafe very seriously. For more information about our security measures, see Security.

Changes to our Terms of Service

The Company reserves the right to periodically review and change the Terms. Continued use of the Service will be deemed as acceptance of such changes.
